Avail AI Terms of Service

20. SMS/Text Messaging Terms

Program Description

Avail provides SMS text message notifications to business administrators who opt-in to receive alerts about:

  • New customer messages and inquiries
  • Booking confirmations, cancellations, and reminders
  • Account updates and important notifications

Consent and Opt-In

By providing your phone number and enabling SMS notifications in your Avail account settings, you expressly consent to receive recurring automated SMS text messages from Avail at the phone number provided. The SMS opt-in checkbox is not pre-checked; you must actively consent by checking the box and providing your phone number.

The following consent language is displayed when you enable SMS notifications:

"By checking this box and providing your phone number, you consent to receive recurring SMS messages from Avail regarding bookings, customer messages, and account updates. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. See our Privacy Policy and Terms of Service."

Consent to receive SMS messages is not a condition of purchasing any goods or services from Avail.

Message Frequency

Message frequency varies based on your account activity and notification preferences. You may receive multiple messages per day depending on customer activity and bookings. Typically, you will receive 1-10 messages per day when SMS notifications are enabled.

Message and Data Rates

Message and data rates may apply. Your carrier's standard messaging rates apply to all SMS messages sent and received. Contact your wireless carrier for details about your messaging plan.

Opt-Out Instructions

You can opt out of SMS notifications at any time by:

  • Replying STOP to any message from Avail
  • Disabling SMS notifications in your Avail account settings
  • Contacting us at support@beavail.com

After texting STOP, you will receive a single confirmation message: "Avail: You have been unsubscribed and will no longer receive SMS messages. Reply HELP for help or START to resubscribe." No further messages will be sent unless you re-enable notifications.

Supported Carriers

SMS notifications are supported on all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, US Cellular, and others. Delivery is subject to carrier network availability. Carriers are not liable for delayed or undelivered messages.

Privacy and Data Sharing

We do NOT sell, rent, lease, or share your phone number or SMS opt-in data with third parties for marketing or promotional purposes.

Your phone number and SMS consent data are handled in accordance with our Privacy Policy. Your phone number may only be shared with:

  • Our SMS service provider (Twilio) solely for message delivery
  • Law enforcement when required by law

By using Avail AI, you acknowledge that you have read and understood these Terms of Service.
